This is a brief that needs to be written. Please take your time and read the following instructions. Brief a case using the FIRAC format discussed in the assigned readings and presentations. Brief any one of the following from Appendix A of the Putman Text (or you may find the case on Westlaw of course): •Stanley v. Illinois (See Appendix A of textbook) Your brief should be 2–4 pages in length, double-spaced. Hint: A case brief does not and should not require outside research, nor should it contain any references to authority not cited in the actual opinion. A brief strictly summarizes and analyzes the contents within a published case, even if that case has since been reversed! If you are briefing a case you have found for your project, please upload a copy of the case along with your brief, to the Dropbox. You will note that there are some variations on exactly how a case can be briefed. Regardless of the exact method you use, you will want to include these components: •Heading (the full citation or caption for the case) •Facts (generally includes a brief procedural history) •Issue(s) (main question(s) that the court asks, analyzes and answers in the case) •Rule: The general principle or rule of law that the court identifies and applies to resolve the case (this is derived from applying existing law to the facts) •Analysis (the heart of the brief — the court’s reasoning and analysis that leads to the conclusion/ruling) •Conclusion (how the case ended or was resolved procedurally; this can include an indication of whether there were dissents)
