PLACE OF LODGEMENT You must submit your assignment electronically via Moodle site VALUE OF ASSIGNMENT 30% LENGTH OF ASSIGNMENT 2,000 words maximum ASSIGNMENT INSTRUCTIONS Read all instructions before completing and submitting the assignment. 1. You are required to submit an answer to the attached assignment question by the due date and time for lodgment. Any requests for extension must be made prior to the due date, see course outline section 4.3 and section 11 for procedure. 2. Your assignment must be submitted soft copy’ via the link that will be made available on Moodle. 3. Your answer must not exceed 2,000 words. The word limit will be strictly enforced. Words in excess of the word limit will not be marked. 4. Your answer must be typed. You must use one and a half (1.5) spacing and a font size of 12. You must leave at least a 2.54 cm margin from both sides of the A4 page (note that this is the normal’ margin setting in Microsoft Word). Single sided printing is preferred. 5. Ensure each page of your answer contains your student number and a page number as a header’. 6. See the style guide for this course posted on Moodle. 7. In preparing an answer, you will inevitably discuss issues raised by the assignment with other students. There is nothing in the UNSW rules prohibiting such discussions. Indeed, you are encouraged to discuss issues arising from the assignment with other students. However, in the end, you must be able to state that the work that you have submitted is your work. Importantly, you should ensure that you have not committed (either deliberately, or without intent) an act of plagiarism (e.g. presenting another’s work or ideas as your own, failing to acknowledge the source of a quotation, submitting the same or similar version of work to that of another student). Due to the potential for damage to reputation, plagiarism is taken very seriously by the university and the Business School. 8. Although the broad topics raised in the assignment will be topics covered in the course, the assignment will raise issues that will not necessarily have been discussed in lectures. This means that you may have to go beyond the prescribed materials for the course in relation to some issues. 9. You should carefully proof-read your answer (a number of times) before submission. Things like incorrect spelling and incomplete sentences will be reflected in the grade for your answer. 10. Once all assignments have been marked, marks will be placed on Moodle. 11. If you are dissatisfied with your grade, you should first collect your assignment and review the feedback given. Discussions regarding grades will not be entered into until you have reviewed your marked assignment. You should then discuss your grade with the lecturer-in-charge. If you are still dissatisfied with your grade, you are allowed to request a formal re-mark. Please note that such a re-mark can result in your grade either (i) staying the same; (ii) being increased; (iii) being reduced. Marking criteria The marker will be evaluating your assignments based on the following criteria: • Knowledge/Critical thinking and problem solving: For ­ correctly identified issues and options available; ­ correctly identified appropriate law (legislation and/or cases as appropriate); ­ correctly applied the law to the facts; ­ providing clear reasoning for the advice you provide in the question. • Written communication/Presentation: ­ Does your assignment have a clear structure? ­ Is it free of errors (such as spelling, grammatical or typographical errors)? ­ Have presentation guidelines provided in the assignment instructions been followed? ­ Have you used a consistent referencing style? % HD Well-structured, referenced and superior discussion of issues raised in the question. Cited cases, legislation and other material correctly. Provided accurate costing for various business structures and IP registration. Demonstrated good research skills. >85 D Well-structured and referencing on the whole good. Provided reasonable costing information. Demonstrated understanding of the issues but poorly explained link between business name, brand name and domain name. Good discussion of intellectual property rights and process. 75-84 CR Reasonable structure. Discussed the points raised by the assignment question but didn’t do extra research or provide accurate costing information. No introduction and reasoning given or failed to give an opinion as to which structure to recommend. . <50 ASSIGNMENT QUESTION Sam Smith is a successful industrial engineer working for a medium sized firm. One of Sam best friends, Anthony Bond has just finished a computer engineering degree achieving high grades in all of his courses. Over drinks one night Sam and Anthony discuss combining both their skill sets and want to investigate starting their own business. Neither Sam nor Anthony has any knowledge of where to start legally to establish a business and how to convert their ideas in a valuable commodity. They have approached you for advice of how to set up a business and how to stand out in the market place. Required: Advise Sam and Anthony on the following: 1. The types of business structures available when setting up a business and recommend which structure you think well suits their needs. 2. The options available to develop a logo, brand name/trade mark and an online presence. 3. Explain how ideas can be converted into property and outline the intellectual property law which recognises and protects this property. For each of the items above please refer to the substantive provisions of legislation which concerns the matters raised and where relevant refer to case law. Clearly state any assumptions in answering the assignment question and provide approximate costings. HINT: You will need to consider what registrations are available and the importance and link between business name, trade mark and domain name. Include costings for initial set up and ongoing costs, in your analysis. Include also discussion of the process and cost of IP protection.
