American Citizens for Corporate Responsibility “ACCR” problem.
The problem is the Board of Directors of nongovernmental organization ACCR’s funding object in its charter is: ” … To achieve the full legal recognition that American corporations have the same responsibility as American human citizens under the law of the United States.”
ACCR has limited funds but has managed to pursue corporate responsibility in US state and federal courts and before and state agencies and legislatures on a variety of issues including respect for civil liberties of employees, limitation liability, and acceptance of duties regarding consumers.
The legal staff of ACCR has asked the Board to approve at its next meeting the allocation of funds for ACCR to pursue in all international fora the adoption of an international set of human rights norms for corporations.
The Board will hear from two members of the legal staff (my classmate and I ) and will vote whether to accept the staff’s recommendation at the end of the meeting. To prepare for the meeting the staff asks the Board to read chapter 2 (pp.49-93 of the case book “International Human Rights: law, policy and process 4th ed David Weissbrodt”). In addition to considering the merits of the staff’s substantive position the Board and staff should be prepared to weight the allocation of money resources needed for such a new undertaking, the impact of such an effort on fund raising for ACCR and the potential need to amend ACCR’s Charter to permit such an undertaking.
So we’re going to break our presentation into 4 parts. If you could prepare the second two points that would be good. For the hard and soft law, just outline what’s mentioned in the text book.

2. What opportunities are on the international stage for NGOs
a. No hard law yet
b. There are many unaddressed issues.
3. The state of international law regarding corporate responsibility
a. Has been indirect so far (holding the state responsible for the actions of the corporation)
b. Existing hard and soft law (for this I would just walk through p 58-69 “International Human Rights: law, policy and process 4th ed David Weissbrodt”)
4. Options for the group to choose from
a. Amend by-laws
b. Apply for ECOSOC status
c. Hire a consultant
d. Reject.
