Discuss how you might make sense of her symptoms in relation to her particular history and cultural traditions

Using the case of Ruth in Chapter 12 (pp. 171-71), discuss how you might make sense of her symptoms in relation to her particular history and cultural traditions. The text gives you some hints, but see if you can carry it further, especially in relation to intergenerational trauma. Refer to other points made by Dr Yellow Horse Brave Heart in this chapter. Are Native Americans the only groups who might be affected by the broad principles Dr Yellow Horse Brave Heart talks about? Explain.

International Intellectual Property Law: The TRIPS Agreement represents the first international measure to harmonise substantive patent provisions

“The TRIPS Agreement represents the first international measure to harmonise substantive patent provisions. Unfortunately this was predominantly for the benefit of developed countries at the expense of developing and least developed countries. The Nagoya Protocol attempts to rebalance that arrangement for traditional knowledge. A similar settlement is required to balance patent protection and the right to public health.”

Critically evaluate this statement with regard to substantive patent protection, the right to public health and the protection of traditional knowledge.

WORD LIMIT – 3500 words (maximum)
The word limit does not include footnotes, appendices or bibliography. Footnotes must be used for references only. Any narrative or description contained within footnotes or appendices will be disregarded by the marker. References must be made in OSCOLA format.

The following rules apply to word limits for the coursework assessment:
a. Word count includes everything in the main body of the text (including headings, tables, citations, quotes, lists, etc.).
b. The references, footnotes (provided footnotes only include references) and bibliography are NOT included in the word count.
c. There is no penalty for exceeding the word count but the marker WILL stop reading once the word limit has been reached and nothing further will be taken into account in the allocation of marks. Therefore students will be penalised for a failure to be concise and for failing to conclude their work appropriately.
d. The word count needs to be clearly and correctly stated on the title page of the assignment. Incorrectly understating the word count constitutes an assessment offence and may result in further action.

Solid control processes is essential for any successful organization

Of course having solid control processes is essential for any successful organization. Some organizations like to seek formal recognition for their control functions through independent certifications such as ISO 9000. In order to receive ISO certification, you need to extensively follow and document a long list of published standards and then have an outside evaluator certify that you are meeting these standards.
ISO certification has both proponents and critics. Proponents argue that meeting ISO standards through certification will improve organizational control functions and also help signal to the outside world that you are running a solid operation with high standards. However, critics point to the huge amount of time and money spent on documentation that may be excessive. Critics also say that ISO focuses on documentation of processes rather than the actual quality/efficiency of the process.
For this assignment, first read up on ISO certification and examine the arguments both for and against it. Then read up on a new start-up company called Clinkle and consider whether or not ISO 9000 would be appropriate for this new company to seek. Clinkle is new online payment company that has received a lot of media attention recently but has also had its ups and downs. It has raised a lot of money from investors but is still at an early stage with no revenue yet.
Here are some articles on ISO certification to get you started:
Seddon, J. (1997). Ten arguments against ISO 9000, Managing Service Quality 7(4), pp. 162-168. [ProQuest]
Wahid, R., & Corner, J. (2009). Critical success factors and problems in ISO 9000 maintenance.
The International Journal of Quality & Reliability Management 26 (9), pp. 881-893.
Here are some articles on Clinkle to get you started:
Smart money follows mobile payment app Clinkle (July 4, 2013). Irish Times, Dublin [ProQuest]
Clinkle raises $25 million in seed financing as it prepares to change the way people transact. (June 27, 2013). Business Wire, New York [ProQuest]
Case Assignment
After doing research and carefully considering whether or not ISO certification is the right option for Clinkle, write a 4- to 5-page paper answering the following questions:
1. What aspects of the control function of management do you think should be the most important to Clinkle?
2. What would be the main benefits to Clinkle of obtaining ISO certification?
3. What would be the main disadvantages to Clinkle of obtaining ISO certification?
4. Overall, should Clinkle invest time and money in ISO certification, or are the resources better spent on other ways to maintain control systems?
Assignment Expectations
• Answer the assignment questions directly.
• Stay focused on the precise assignment questions; don’t go off on tangents or devote a lot of space to general background materials.

For this final SLP you will be looking closely at the control function of management within your organization (STARBUCKS ORGINAZATION) . All organizations have numerous methods of control, but think carefully about what control mechanisms are most vital for your organization’s success. Then write a 2- to 3-page paper answering the following question:
• What control mechanisms at your organization are (or should be) the most useful or important for the success of your organization?
Focus in particular on the core technologies of the organization as applied to the control function of management. You can discuss control efforts and strategies already utilized by your company, and/or make recommendations that you believe would be useful for your organization to consider.
Begin your essay with a thesis statement in the introductory paragraph that identifies what you consider to be the key organizational control efforts that are (or would be) important to the success of your organization, and then develop a persuasive essay to support your thesis.
Remember to use background readings to support your key arguments and to cite and reference your sources. Your goal is to convince your professor, who will require some well-reasoned and well-supported arguments. Actual examples of control and accountability systems in action and how they work in your organization will also help to add support to your arguments, but you need to go beyond just being descriptive and provide some convincing arguments in favor of your position.

Critical Thinking Legal Case

Your score will be determined using the Critical Legal Thinking Case Rubric. Please read this rubric thoroughly BEFORE attempting this assignment.

Your score will be determined by evaluation of your substantive content. Your analysis and solutions must be based on the principles of law, ethics, and business – not on your opinions. You MUST describe how application of the principles to the key facts support your determination of the issues, in other words, you need to show the reasoning behind your decision.

Key facts are those facts that determine if the principles of law are met. You must demonstrate that you recognize the key facts in this case. List the key facts individually. Do NOT simply repeat or retype the factual scenario.

The length of your response has no bearing on your score. There is no minimum or limit, however most responses will be between two and three substantial pages.

Your assignment must be prepared using APA format. See the Tools and Resources page for more information about APA styling.

Sterling, Inc. is a manufacturer of state-of-the-art computers. For the past ten years, Sterling has acquired all of its microchips from NoBugs Corporation, the only producer of chips meeting Sterling’s high specifications. The relationship has been mutually profitable. Sterling could not have built its reputation as an industry leader without NoBugs’s reliable and consistently high-quality products; Sterling’s business has enabled NoBugs to grow rapidly while providing its investors with an attractive rate of return.

Some months ago, several of Sterling’s computers exploded shortly after installation. Upon investigation, Sterling discovered that tiny imperfections in NoBugs’s microchips had aggravated a dormant design defect in the computers, causing the explosions. Analysis of the chips indicated that they were indeed below specifications and that the imperfections were caused by a slight miscalibration of NoBugs’s encoding equipment. NoBugs recalibrated the equipment and promptly resumed production of perfect chips.

Sterling’s losses from the explosions – lost profits, out-of-pocket costs associated with compensating customers for the explosions, and injury to business reputation – are estimated to exceed $20 million. Sterling and NoBugs disagree on the amount of the loss for which NoBugs should be responsible. Sterling has a strong legal case for breach of contract against NoBugs. Sterling’s CEO is considering a lawsuit. She asks you to prepare a report discussing litigation strategy and the advantages and disadvantages of litigation; and discussing pretrial planning should the company opt for litigation.
