The Assertive Technology Act was originally signed into congress in 1988, but it wasn’t until the 1998 (P.L. 105-394) amendment that there was a strong focus on addressing the assistive technology needs of individuals with disabilities in order to provide an equal and appropriate education. The Act authorized funding for high-tech (typically requires training), mid-tech (typically requires batteries but is fairly simple to operate), and low-tech devices (no batteries needed) that are “used to increase, maintain, or improve the functional capabilities of children with disabilities” (Connecticut State Department of Education & The Connecticut Birth to Three System, 1999, p. 3).

You are a new associate at the law firm of Dewey, Chetum, and Howe. John, a former researcher at PharmaCARE, comes to your office. He has concerns about PharmaCARE’s use of AD23, one of the company’s top-selling diabetes drugs. Two (2) years ago, after PharmaCARE’s research indicated that AD23 might also slow the progression of Alzheimer’s disease, John and his team of pharmacists began reformulating the drug to maximize that effect. In order to avoid the Food and Drug Administration’s (FDA) scrutiny, PharmaCARE established a wholly-owned subsidiary, CompCARE, to operate as a compounding pharmacy to sell the new formulation to individuals on a prescription basis. CompCARE established itself in a suburban office park near its parent’s headquarters. To conserve money and time, CompCARE did a quick, low-cost renovation.

CompCARE benefited from PharmaCARE’s reputation, databases, networks, and sales and marketing expertise, and within six (6) months had the medical community buzzing about AD23. Demand soared, particularly among Medicare, Medicaid, and Veterans Affairs patients. Seeing the opportunity to realize even more profit, CompCARE began advertising AD23 directly to consumers and marketing the drug directly to hospitals, clinics, and physician offices, even though compounding pharmacies are not permitted to sell drugs in bulk for general use. To circumvent this technicality, CompCARE encouraged doctors to fax lists of fictitious patient names to CompCARE. PharmaCARE sold CompCARE to WellCo, a large drugstore chain, just weeks before AD23 was publicly linked to over 200 cardiac deaths.

As CompCARE and its new parent company enjoyed record profits and PharmaCARE’s stock price approached $300 per share, reports started surfacing that people who received AD23 seemed to be suffering heart attacks at an alarming rate. The company ignored this data and continued filling large orders and paying huge bonuses to all the executives and managers, including John, whose wife recently died from a heart attack after using AD23.

John has come to you with an internal company memo describing the potential problems with AD23, and information describing the company’s willingness “roll the dice” and continue to market the drug.

Your senior partner has asked you to write a memo outlining the following issues for review by the senior partners.

In preparation for this assignment, use the Internet or Strayer Library to research examples of intellectual property theft that occurred within the past two (2) years.

Write an eight to ten (8-10) page paper in which you:

5.Summarize at least one (1) current example (within the past two [2] years) of intellectual property theft, and examine the effect on that company’s brand.
6.Analyze the potential issue surrounding the death of John’s wife and other potential litigants against PharmaCARE as a result of AD23.
7.Specify both the major arguments that John can make to claim that he is a whistleblower and the type of protections that he should be afforded. Justify your response.

Examining your Primary Sources (Weeks 8-10)

The goal of these next three weeks is to work with the primary sources that you have chosen. This is an important step for two reasons:
1.You will be trying your hand at the act of historical interpretation (really trying to make sense of the primary sources you have chosen);
2.You will be learning more about happiness by linking your sources to the chronological period about which you have been studying.
So here are your tasks for weeks 8-10.

You should carefully examine your five primary source sand write an essay (of about 500-750 words) in which you interpret any three of those sources. (If you prefer to interpret four or all five of your sources, feel free to do so.) Your interpretation should include:

1.a description of the main ideas, values, feelings, worldviews, that you find in your document(s);
2.a discussion of how the specific words or images—clues—that you have found in your source help you interpret that document; and
3.an analysis of the ways in which what you see in your primary source offers you insight into the major themes, problems, and/or concerns about “happiness” relevant to your period. (This is a place where you should consult and refer explicitly to the background readings on your period that you have done.)
Three Notes

Note 1: When writing this short essay, you will want to find “evidence.” That is, you don’t want to only assert something, but to show your own thinking—your own act of carefully interpreting. This could mean your detailed description of a photograph, or it could mean using a direct quote (putting the text between quotation marks) from your document (always properly cited–that is, identifying the source) and helping your reader understand why you interpreted your source as you did. As your readers, we have to make sense of how you understood your source.

Note 2: Of course, you do not have to “agree” with your source; for example, you may think that the ideas expressed in a political tract that you have found are antithetical to your own, or the images in a cartoon are ones that you might find offensive (or maybe even quite the opposite!). But, above all, you should be digging and questioning and doing your best to understand this source and trying to looks for links between it and your historical period.

Note 3: Your essay should draw some conclusions, however tentative you think they might be. So, you should be asking yourself: what have I learned about happiness as a result of my careful reading of and reflection on these sources? Do I have some insights or even some new questions (and, of course, new questions are also important outcomes) that I may not have had before?
