Gregg v. Georgia

In Gregg v. Georgia, the Supreme Court offered the following understanding of its own decision in Furman: Furman mandates that where discretion is afforded a sentencing body on a matter so grave as the determination of whether a human life should be taken or spared, that discretion must be suitably directed and limited so as to minimize the risk of wholly arbitrary and capricious action. With reference to my article, “Gregg at 40,” describe three different kinds of studies that have attempted to empirically assess the concepts of “suitably directed” and “minimization of risk.” Offer a critique of my conclusion that Gregg has been “a complete and dismal failure.” To do this, offer evidence that shows Gregg actually has curtailed arbitrariness and/or expose flaws in the evidence that has been used to demonstrate continued arbitrariness.

Stereotypes

Please respond to the following below…. When reflecting on stereotypes overall in society there are two things I consider. There are positive stereotypes that empower various demographics. On the other hand, negative stereotypes are what catches the most attention. The negative stereotypes have some truth to it and these accusations come from situations that people observe. However, having these stereotypes hinders these various demographics. For example, when it comes to quantitative performance men are said to have better mathematics skills (Shih et al., 1999). When women are identified as having lower mathematics skills, reports say that the performance of those women lowers compared to a control group that did not have the stereotype identified (Shih et al., 1999). I look at these effects of negative stereotypes and many situations in my work place come to mind. There is a particular one that sticks out to me because of how blatantly stereotypical it was. I work at Starbucks and have been for a long time. There was a particular employee of Latino decent and he worked just as hard as the other employees. There was a supervisor that had this employee of Latino decent do all the cleaning an what is classified as “dirty” jobs every time he worked. I was on break one day and heard that supervisor talking to another employee about doing floors and she explained to the employee that she was going to have the Latino employee do the floors. She then continued to explain that she has him do it because “Mexicans always work hard and do not mind doing the dirty work.” Hearing this made me furious and saw how stereotypes exist in many situations, especially in the workplace. Retelling the story it makes me think critically of how there are positive stereotypes and negative stereotypes as explained in the textbook. In this work situation the negative stereotype is very clear. The negative stereotype is that “Latinos don’t mind doing the dirty work.” But, there is also a positive stereotype in this situation. That positive stereotype in this situation is “Latinos always work hard.” Having that stereotype is something that people would praise and think is a very good quality to have. In my work situation, having this positive stereotype led to this employee doing all the hard work because he performed so well in those tasks. This is unfair because only he was doing the hard work and the rest of the employees never had to do this same hard work while he was working. When in comes to stereotyping in the workplace, there are many implications it can have on employees as regards to self-fulfilling prophecies. Self-fulfilling prophecies occur many times in the workplace and this entails when there are false expectations of people and that expectation gets fulfilled (Robbins & Judge, 2015). In other words, having these false expectations usually end in creating that new behavior to make that expectation true (Biggs, 2009). In a workplace, managers tend to exert self-fulfilling prophecies frequently and the prophecies usually become true. I have worked with managers who express these self-fulfilling prophecies both positively and negatively. References Biggs, M. (2009). Self-fulfilling prophecies. JUDAISM

• JUDAISM . This week tackles the riddle of human nature: Are humans basically good, evil, neutral, or a mixed bag? Be sure to refer to reference materials in the folders, and follow the instruction prompts. At one point in her diary, Anne Frank seemed to affirm that humans are basically good (the optimism of youth?). Rutka’s shorter, more terse and terrifying diary might implicitly suggest that humanity’s basic tendency is toward evil, or at best, indifference. She seems more ambiguous on this matter. Then there’s the “heroes” like Irena Sendler, and the less-than-likely hero who is a poster “child” for moral ambiguity: Oskar Schindler. What do you make of all this? Before responding, students are to carefully follow the specific instruction prompts in which responses can be drawn from a number of required resources to support viewpoints. At times it seems we can be breathtakingly sacrificial, loving, and altruistic…and then we can sink if not to the depths of degradation, then to cold indifference, selfishness, hardness of heart, with no empathy or sympathy. What are we to make of ourselves? What’s your take on human nature? Be sure to follow instructions, ponder this question by carefully, and view/analyze a number of resources provided in this week’s folders before posting your thoughtful, and substantive response. Digging deeper materials, which might help. https://www.youtube.com/watch?v=4OnWNDigXF8#action=share http://lucifereffect.com/ http://www.bywayofbeauty.com/2012/07/a-cinematic-tour-of-problem-of-evil.html

Furman v. Georgia

A. Answers should be printed in 12-point font, single spaced, doubled-sided pages. B. Each answer is restricted to 500 words. Print your word count for each answer at the end of the answer. C. You may discuss the questions with your classmates. But all written work must be your own. Violations will be punished by death. 1. In Furman v. Georgia, Justice Thurgood Marshall wrote: It is generally agreed between the retentionists and abolitionists, whatever their opinions about the validity of comparative studies of deterrence, that the data which now exist show no correlation between the existence of capital punishment and lower rates of capital crime. Despite the fact that abolitionists have not proved non-deterrence beyond a reasonable doubt, they have succeeded in showing by clear and convincing evidence that capital punishment is not necessary as a deterrent to crime in our society. In light of the massive amount of evidence before us, I see no alternative but to conclude that capital punishment cannot be justified on the basis of its deterrent effect. Could Marshall make the same statement today? In answering this question, you should explain the methodological complexities of studying deterrence, and describe and evaluate three studies that examined deterrence and/or brutalization. The critical point here is to deal with the certainty of Marshall’s evaluation of the deterrence evidence.

Beowulf

In the second third of our course, we read the entirety of Beowulf and Dante’s Inferno, excerpts from Chaucer’s Canterbury Tales, Marie de France’s lay of Lanval, and also “Sir Gawaine and the Green Knight”. For our second exam, you will write on these texts individually and in relation to each other. Demonstrate your knowledge of the material through specific reference to the text. Do not go beyond the text we read for the class; in other words, do not use excerpts from Chaucer, Dante or Marie de France which were not included in our book, and do not use additional outside articles or scholarship. You need nothing for this exam beyond our own reading. Instead, spend your time proving that you know the material. Always remember to have a thesis; back up your argument with specific reference to the text. This is a “take home” exam and, for that reason, I expect you to proofread, revise, and edit your work before you submit it. Do not force me to grade work which is not your best; neither you nor I will be happy with the results! All exams are due by 6pm on Thursday the 31st in our D2L dropbox. Use Times New Roman 12 point font, double spaced. Make sure your name and the course number are on the paper. SHORT ANSWER QUESTIONS Answer three (3) of the following questions with short essays of 1-2 paragraphs each. 1: Leaving aside the obvious physical fact that he is older and thus not as strong as he once was, to what extent is the Beowulf seen in the dragon episode changed or different from the Beowulf seen in the first two parts of the tale? What factors do you blame for these changes, or for his resistance to change? 2: Analyze Dante’s portrayal of pity in the Inferno. Who displays pity, how is it performed, and what does it accomplish? What, if anything, is Dante the author saying about pity? 3: Outline Marie de France’s use of the technique of inversion, the reversal of expected and traditional tropes and narrative patterns. 4: Are Chaucer’s characters honest or dishonest? That is, are they truth-tellers or are they liars, and what value or worth is ascribed to their honesty or deceitfulness? 5: If “Sir Gawaine and the Green Knight” is a teaching text, a story intended to teach something to the reader, what is it teaching? That is, what is its theme or its point, if it has one, and how is this process of education working or reflected in the text? SINGLE LONG ESSAY Select ONE of the following questions and write a complete and thoughtful essay in response, using texts you have NOT already written about in the short answer half of the exam. In other words, if you wrote about Beowulf in question 1 above, do not write about Beowulf again here. If an author has multiple texts in our book (Chaucer’s multiple tales, for example, or Marie de France), you may discuss one of them in the short answer and a different one in this long essay. Do not write on more than one question! A: To what extent are the texts we have read in this section of the course “realistic”? Be specific, using multiple authors to illustrate moments of realism in the text. What does this realism accomplish, and how effective is it? Is this realism out of place alongside other more fantastic elements in these stories, or do these authors succeed in integrating realism and fantasy in the same text? B: Discuss the portrayal of sex and sexuality by at least two of the authors we have read. Can we broadly characterize those authors’ depictions of sexuality in any useful way? Do you see similarities in the way these authors present sexuality, or only difference? C: Consider the portrayal of fame, and the value of fame, in works by at least two different authors we have read. How important is public fame and, when contrasted to private happiness, is it portrayed as more important, more rewarding, or more valuable? When characters are obliged to choose between public fame and private happiness, what do they choose, and is this choice portrayed as wise or unwise, and what is that saying about fame in general?
