New technologies in the workplace allow employers to use wireless RFID devices to track employees’ movement in the clinical workspace. Baylor College of Medicine will be implementing a new patient tracking system that will generate reports on how long patients wait to see the doctor, as well as how long technicians and doctors take to see the patient. This has caused some legal opinions with both the doctors and employees. With new healthcare laws in place, BCM is looking for ways to improve patient wait time in their clinics, to avoid being fined by Medicare for unhappy patients. If BCM can improve patient wait time by utilizing new technologies, they should be able to improve patient satisfaction, thus avoiding penalties by Medicare. The wireless tracking devices used for patient tracking is worn on the doctor, technician, and patient. A report is generated on a weekly basis to show where potential problems may be, and compares how other doctors are performing. The legal issue that needs to be addressed and visited is quite clear. Is it legal for BCM to track their employees and doctors if they choose not to be part of the new implementation? Can an employee or doctor be disciplined for refusing to be tracked during scheduled clinical time?

The paper is to address either litigation prevention or the management of litigation or litigation-related problems.
The paper will be graded based upon content and analysis. I am not looking for purely informative papers. For example, do not submit a paper that merely educates me about hazard communications. If you want to discuss hazard communications, tell me how they are defective, how they could be improved, or why they are adequate to meet your company’s (or your industry’s) needs.
Paper Criteria: The course paper should be not fewer than five nor more than ten pages, exclusive of authorities (i.e., eight pages plus two of bibliography is only an eight-page paper) and must be typed.. Handwritten papers will not be accepted. Acceptable fonts are Times New Roman, CG Times, Bookman, and Arial in 12-point type size. No other fonts will be accepted. Margins are to be one inch on all four sides and spacing is to be double-spaced. Citations and authorities are to be either footnoted or embedded in the text with an attached bibliography. Non-conforming papers will not be accepted and will result in failing grades. Authorities must actually be authoritative. (For example, ranting editorials on an NRA-oriented web-site are not authoritative.
