Employee and Patient Tracking Litigation Prevention

New technologies in the workplace allow employers to use wireless RFID devices to track employees’ movement in the clinical workspace. Baylor College of Medicine will be implementing a new patient tracking system that will generate reports on how long patients wait to see the doctor, as well as how long technicians and doctors take to see the patient. This has caused some legal opinions with both the doctors and employees. With new healthcare laws in place, BCM is looking for ways to improve patient wait time in their clinics, to avoid being fined by Medicare for unhappy patients. If BCM can improve patient wait time by utilizing new technologies, they should be able to improve patient satisfaction, thus avoiding penalties by Medicare. The wireless tracking devices used for patient tracking is worn on the doctor, technician, and patient. A report is generated on a weekly basis to show where potential problems may be, and compares how other doctors are performing. The legal issue that needs to be addressed and visited is quite clear. Is it legal for BCM to track their employees and doctors if they choose not to be part of the new implementation? Can an employee or doctor be disciplined for refusing to be tracked during scheduled clinical time?
